Zakatify | Terms of service

Your use of Zakatify Services is subject to these Terms of Service ("TOS"). By using Zakatify Services, you signify your irrevocable acceptance of this TOS as well as the Zakatify Privacy Policy, which is incorporated herein by reference. If you do not agree to any of these terms, please do not use Zakatify Services. Zakatify LLC reserves the right to update and change the TOS and/or the Privacy Policy from time to time without notice or acceptance by you, and you agree to be bound by any such modifications or revisions. Nothing in the TOS and/or Privacy Policy shall be deemed to confer any third-party rights or benefits.

Definitions

The following definitions will be used in these Terms of Service:

"Zakatify LLC," "we," "us," or "our" refers to Zakatify LLC, a Virginia limited liability corporation.
“Zakatify Services” are the online properties, mobile applications, products, and services owned and operated by Zakatify LLC.
An “Account Holder” is a user that has registered an account on Zakatify Services.
A "User," “you,” “your” refer to anyone who accesses, browses, views, or in any way uses Zakatify Services, including Account Holders.
"Your Content" means Content that you submit, post, or transmit to, or using, Zakatify Services, such as the charity ratings, reviews, compliments, information that you display as part of your account profile, invitations, or other commentary that you may submit, post, or transmit to, or using, Zakatify Services. Your Content does not include the information that you submit in order to create an account on Zakatify Services.
"User Content" means content that users submit, post, or transmit to, or using, Zakatify Services.
"Third Party Content" means Content that is made available on Zakatify Services by parties other than Zakatify LLC or the users, such as data providers that license data to Zakatify LLC for use on Zakatify Services.
"Content" means all of the content (text, images, photos, audio, video, and all other forms of data or communication) created by or managed on Zakatify Services including Your Content, User Content, and Third Party Content.
“Zakat” refers to the aggregate zakat-eligible donations made by a user, while “Donation” refers to a single transaction with a charity made on Zakatify Services.
“PayPal” refers to PayPal Inc, the payment processor for donations made on Zakatify.
“PayPal Giving Fund” refers to a Donor Advised Fund (“DAF”) recognized by the Internal Revenue Service (“IRS”) under Section 501( c )(3) of the Code as a tax-exempt public charity (Federal Tax ID: 45-0931286). PayPal Giving Fund receives donations made on Zakatify.

Description of service

Zakatify LLC allows Account Holders to manage charitable donations in conjunction with PayPal Giving Fund ("PPGF"). Once registered with Zakatify Services, each Account Holder has the ability to browse and review Content and initiate automatic or monthly donations to listed charities. Unless explicitly stated otherwise, any new features that augment or enhance Zakatify Services, including the release of new Zakatify LLC tools and resources, shall be subject to the TOS. In order to use Zakatify Services, you must obtain access to an Internet-connected device and pay any service fees associated with such access. In addition, you must provide all equipment necessary to make such connection to the Internet, including computers, smartphones, or other access devices. You also understand and agree that the service may include certain communications from Zakatify LLC, such as service announcements, administrative messages and Zakatify Services newsletters, and that these communications are considered part of Zakatify Services membership. You agree not to access Zakatify Services by any means other than through the interfaces that are provided by Zakatify LLC for use in accessing Zakatify Services.

Your donation will be made to PPGF, a 501(c)(3) charity, and is subject to PPGF’s policies and terms of service for donors. Donations are subject to Zakatify's platform fee and to payment processing fees, and PPGF makes grants to benefiting charities net of those fees. The charity you recommend will typically receive the funds within 15-45 days of your original donation. In the unlikely event that PPGF cannot deliver donations to the charity you recommend, it will whenever possible seek a new recommendation from you. To ensure your donation remains Zakat-eligible, you should recommend another charity from Zakatify’s directory. If no recommendation is given, PayPal Giving Fund will reassign the funds to another charity, which has been vetted by PPGF.

Registration

In order to use Zakatify Services, you must have a valid Zakatify Services account. This means that you must provide Zakatify LLC with your name, a valid email address and other information ("Registration Data"). As an Account Holder, you will choose a password and account designation for your membership during the Service's registration process. You are responsible for maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify Zakatify LLC in writing of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. Zakatify LLC cannot and will not be liable for any loss or damage arising from your failure to comply with this Section. In consideration of use of the Service, you agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the Service's registration form, and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or Zakatify LLC has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Zakatify LLC has the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof).

Cancellation and termination

If you cancel one or more Zakatify Services, your cancellation will take effect immediately. After cancellation, you will no longer have access to your account and all information contained therein may be deleted by Zakatify LLC. Zakatify LLC accepts no liability for such deleted information or content.

You agree that Zakatify LLC, in its sole discretion, may terminate your password, and/or account, and remove and discard any Content within Zakatify Services (including, but not limited to reviews created by you), for any reason, including and without limitation, the lack of use, or if Zakatify LLC believes that you have violated or acted inconsistently with the letter or spirit of the TOS. Any contracts, verbal or written or assumed, in conjunction with your deleted content (as applicable) and all its parts, at Zakatify LLC's discretion, will be terminated as well. Zakatify LLC may also in its sole discretion and at any time, discontinue providing Zakatify Services, or any part thereof, with or without notice. You agree that any termination of your access to Zakatify Services under any provision of this TOS may be effected without prior notice, and acknowledge and agree that Zakatify LLC may immediately deactivate or delete your account, as applicable, and all related information and files. Zakatify LLC reserves the right to bar any further access to Zakatify Services. You agree that Zakatify LLC shall not be liable to you or any third-party for any termination of your access to Zakatify Services.

Zakatify LLC Privacy Policy

Use of Zakatify Services is subject to our Privacy Policy, the terms of which are incorporated into this TOS by reference. Please see the Privacy Policy for details.

Ownership of account and security

You are responsible for maintaining the security of your account on Zakatify Services, and you are fully responsible for all activities that occur under the account and any other actions taken in connection with your account. You agree to immediately notify Zakatify LLC in writing of any unauthorized uses of the account or any other breaches of security. Zakatify LLC cannot and will not be liable for any loss or damage from your failure to comply with this security obligation. You acknowledge and agree that under no circumstances will Zakatify LLC be liable, in any way, for any acts or omissions by an Account Holder or a Guest, including any damages of any kind incurred as a result of such acts or omissions.

Rules and regulations regarding content and conduct

You understand that all Content is the sole responsibility of the person from which such Content originated. You, and not Zakatify LLC, are entirely responsible for all Content that you upload, post, transmit or otherwise make available via the Service. Zakatify LLC does not control the Content posted via Zakatify Services and, as such, does not guarantee the accuracy, integrity or quality of such Content.

You understand that by using Zakatify Services, you may be exposed to Content that is offensive, indecent or objectionable. Under no circumstances will Zakatify LLC be liable in any way for any Content, including, but not limited to, for any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, transmitted or otherwise made available via the Service. You acknowledge that Zakatify LLC may pre-screen Content, and that Zakatify LLC and its designees shall have the right (but not the obligation) in their sole discretion to refuse, move or delete any Content that is available via Zakatify Services. Without limiting the foregoing, Zakatify LLC and its designees shall have the right to remove any Content that violates the TOS or is otherwise objectionable in Zakatify LLC's sole discretion. You agree that you must evaluate, and bear all risks associated with, the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content. In this regard, you acknowledge that you may not rely on any Content created by Zakatify LLC or submitted to Zakatify LLC. You acknowledge and agree that Zakatify LLC may preserve Content and may also disclose Content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce the TOS; (c) respond to claims that any Content violates the rights of third-parties; or (d) protect the rights, property, or personal safety of Zakatify LLC, its users and the public.

You understand that the technical processing and transmission of Zakatify Services, including your Content, may involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.

Should Content be found or reported to be in violation with, but not limited to, the following terms, it will be in Zakatify LLC's sole discretion as to what action should be taken.

You agree that you will not:

upload, post, transmit or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another's privacy (up to, but not excluding any address, email, phone number, or any other contact information without the written consent of the owner of such information), hateful, or racially, ethnically or otherwise objectionable;
solicit personal information from minors or to harm or threaten to cause harm to minors;
impersonate any person or entity, including, but not limited to, a Zakatify LLC official, listed charity, or falsely state or otherwise misrepresent your affiliation with a person or entity;
forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through Zakatify Services;
upload, post or otherwise transmit any Content that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);
upload, post or otherwise transmit any Content that infringes any third-party right, including breach of confidence, copyright, patent, trademark, trade secret, moral right, rights of privacy or publicity, or other intellectual property or proprietary right;
upload, post, or transmit unsolicited commercial email or "spam". This includes unethical marketing, advertising, or any other practice that is in any way connected with "spam," such as (a) sending private messages or emails to users who haven't requested contact from you or with a fake return address or fake/anonymous identity, (b) promoting a site with inappropriate links, titles, descriptions, or (c) promoting your site by posting multiple submissions in public forums that are identical;
upload, post or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
interfere with or disrupt the Service or servers or networks connected to Zakatify Services, or disobey any requirements, procedures, policies or regulations of networks connected to Zakatify Services;
intentionally or unintentionally violate any applicable local, state, national or international law, including, but not limited to, regulations promulgated by the U.S. Securities and Exchange Commission, any rules of any national or other securities exchange, including but not limited to, the New York Stock Exchange, the American Stock Exchange or the NASDAQ, and any regulations having the force of law;
"stalk" or otherwise harass another account holder, guest, or third party unrelated to Zakatify Services and/or record, process, or mine information about other users;
promote or provide instructional information about illegal activities, promote physical harm or injury against any group or individual, or promote any act of cruelty to animals. This may include, without limitation, providing instructions on how to assemble bombs, grenades and other weapons or incendiary devices;
offer for sale or sell any item, good or service that (a) violates any applicable federal, state, or local law or regulation, (b) you do not have full power and authority under all relevant laws and regulations to offer and sell, including all necessary licenses and authorizations, or (c) Zakatify LLC determines, in its sole discretion, is inappropriate for sale through Zakatify Services;
use Zakatify Services as a forwarding service to another website or application of any kind;
solicit passwords or personal identifying information for commercial or unlawful purposes from other users;
exceed the scope of Zakatify Services that you have signed up for; for example, accessing and using the tools that you do not have a right to use, or deleting, adding to, or otherwise changing other people’s comments or content;
engage in commercial activities within Zakatify Services or on behalf of Zakatify without prior approval. This includes, but is not limited to, the following activities:

uploading content that is designed to profit you or any other business or organization;
uploading content describing services that provide cash or cash-equivalent prizes to users in exchange for hyperlinks to their web sites; and
utilize user-submitted content sections of the Service to promote commercial interests.

obscure any advertisements from general view via HTML/CSS or any other means;
make any automated use of the system or reverse engineer any portion of Zakatify Services;
use any robot, spider, site search/retrieval application, or other automated device, process or means to access, retrieve, scrape, or index Zakatify Services;
access, retrieve or index Zakatify Services to construct or populate a searchable database of charities and charity reviews;
remove or modify any copyright, trademark or other proprietary rights notice on Zakatify Services or on any materials printed or copied off of Zakatify Services;
take any action that imposes, or may impose in our sole discretion, an unreasonable or disproportionately large load on Zakatify Services’ technology infrastructure;
reformat or frame any portion of Zakatify Services;
modify, adapt, appropriate, reproduce, distribute, translate, create derivative works or adaptations of, publicly display, sell, trade, or in any way exploit Zakatify Services or Content (other than Your Content), except as expressly authorized by Zakatify LLC;
attempt to gain unauthorized access to Zakatify Services, user accounts, computer systems or networks connected to Zakatify Services through hacking, password mining or any other means;
use Zakatify Services or Content to transmit any computer viruses, worms, defects, Trojan horses or other items of a destructive nature (collectively, "Viruses");
use any device, software or routine that interferes with the proper working of Zakatify Services, or otherwise attempt to interfere with the proper working of Zakatify Services;
make excessive traffic demands;
use Zakatify Services to violate the security of any computer network, crack passwords or security encryption codes;
disrupt or interfere with the security of, or otherwise cause harm to, Zakatify Services or Content; and
remove, circumvent, disable, damage or otherwise interfere with any security-related features of Zakatify Services, features that prevent or restrict the use or copying of Content, or features that enforce limitations on the use of Zakatify Services.

If any user is reported to be in violation with the letter or spirit of these terms, Zakatify LLC retains the right to terminate such account at any time without further warning.

Additional software

With respect to any additional features that may be made available by Zakatify LLC in connection with Zakatify Services, if you elect to download or access such additional features or third party Content made available to you through Zakatify Services, you understand that you may have to agree to additional terms and conditions before you use such software or third party Content.

You also agree that the use of any third party services or Content obtained through Zakatify Services does not transfer to you any rights, title or interest in or to the software or such Content, and that you will not use any third party Content made available to you through Zakatify Services except as expressly authorized under that third party provider's terms of service or license. For greater certainty, by accessing third party services or Content made available through Zakatify Services, you are deemed to agree to the terms of service or license agreement posted on Zakatify Services, the terms of which are incorporated by reference herein for the benefit of such third party providers. If you do not agree to the terms of service or license agreement, do not access third party services or Content.

Beta test warning

Zakatify Services are constantly evolving, with new services and features added regularly. You understand and agree that Zakatify Services may still contain software bugs, suffer disruptions and not operate as intended or designated. Your use of Zakatify Services at this stage signifies your understanding of and agreement to participate in the beta testing of new services and features.

International use

Recognizing the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable Content. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from the United States or the country in which you reside.

Submitted content

Zakatify LLC does not claim ownership of Your Content you place on Zakatify. By submitting Your Content to Zakatify LLC for inclusion on Zakatify, you grant Zakatify LLC a world-wide, royalty-free, and non-exclusive license in perpetuity to reproduce, modify, adapt and publish Your Content for the purpose of displaying, distributing and promoting Your Content on Zakatify Services as well as for marketing purposes.

You acknowledge that Zakatify LLC may pre-screen Your Content, and that Zakatify LLC and its designees shall have the right (but not the obligation) in their sole discretion to refuse or remove any of Your Content that is available via Zakatify Services. Without limiting the foregoing, Zakatify LLC and its designees shall have the right to remove any of Your Content that violates the TOS or is otherwise objectionable. You agree that you must evaluate, and bear all risks associated with, the use of Your Content, including any reliance on the accuracy, completeness, or usefulness of Your Content.

Copyright information

All software, information, graphics, text, and the layout/design of website and mobile applications are copyrighted by Zakatify LLC. All rights are reserved. Any use of the materials contained on Zakatify Services other than that noted above is strictly prohibited unless prior written authorization is granted by Zakatify LLC. The Zakatify name and logo are the trademarks of Zakatify LLC. All other trademarks, product names, charity names and logos contained in this web site are the property of their respective owners.

Responsibility for Your Content You are solely responsible for Your Content. You assume all risks associated with use of Your Content, including any reliance on its accuracy, completeness or usefulness by others, or any disclosure by you of information in Your Content that makes you personally identifiable. You represent that you own, or have the necessary permissions to use, and authorize the use of Your Content as described herein. You may not imply that Your Content is in any way sponsored or endorsed by Zakatify LLC.

Because you alone are responsible for Your Content (and not Zakatify LLC), you may expose yourself to liability if, for example, Your Content violates a third party's rights, including any copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right; contains material that is false, intentionally misleading, or defamatory; contains material that is unlawful, including illegal hate speech or pornography; exploits or otherwise harms minors; or violates or advocates the violation of any law or regulation.

Copyright dispute policy

Zakatify LLC has adopted the following policies and procedures toward copyright infringement in accordance with Title 17, United States Code, Section 512(c), which is part of the Digital Millennium Copyright Act ("DMCA"). The address of Zakatify LLC's Designated Agent to Receive Notification of Claimed Infringement ("Designated Agent") is ℅ Shahed Amanullah, 344 Maple Avenue West, Suite 143, Vienna, VA 22180. It is Zakatify LLC's policy to (i) respond to notices of alleged copyright infringement that comply with the DMCA; and (ii) terminate the accounts of those determined by Zakatify LLC to be "repeat infringers."

Procedure for reporting copyright infringements

If you are a copyright owner or agent thereof, and believe that your copyright is being infringed in connection with the Content on Zakatify Services, please send a written notification to the Designated Agent detailing the alleged infringement. Your written notification must include:

identification of the copyrighted work on Zakatify Services that you claim has been infringed;
identification of the Content on Zakatify Services that allegedly infringes upon the copyrighted work at issue, and information reasonably sufficient to permit Zakatify LLC to locate such Content;
a statement by you that you have a good faith belief that the use of the Content identified in your notice in the manner complained of is not authorized by the copyright owner, its agent, or the law;
a statement by you in which you attest, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf; and
your physical or electronic signature, together with your contact information (address, telephone number and, if available, email address).

Please note that Zakatify LLC may, at its sole discretion, send a copy of such notices (with personal information removed) to third parties for publication. Please note that you may be subject to liability under Section 512(f) of the DMCA if you materially misrepresent that content on the Site infringes your copyright.

Procedure to supply a counter-notice to Zakatify LLC

If you believe that Content has been mistakenly removed from Zakatify Services pursuant to this DMCA policy, you may send a written counter-notice to the Designated Agent including the following:

identification of the Content that was removed, and the location on Zakatify Services where it would have been found prior to its removal;
a statement under penalty of perjury that you have a good faith belief that the Content was removed as a result of a mistake or misidentification;
a statement that you consent to the jurisdiction of the Federal District Court for any judicial district in which Zakatify LLC is located, and that you will accept service of process from the person who provided notification under 512(c)(1)(C) or an agent of such person; and
your physical or electronic signature, together with your contact information (address, telephone number and, if available, email address).

Advertisers

You understand and agree that Zakatify Services may include advertisements and that these advertisements may be necessary for Zakatify LLC to provide Zakatify Services. By using Zakatify Services, you agree that Zakatify LLC has the right to run such advertisements with or without prior notice, and without recompense to you or any other user. The manner, mode and extent of advertising by Zakatify LLC on Zakatify Services are subject to change at Zakatify LLC's discretion. Your correspondence or business dealings with, or participation in promotions of, advertisers found on or through Zakatify Services, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser. You agree that Zakatify LLC shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on Zakatify Services.

Links

Zakatify Services may provide, or third parties may provide, links to other online resources (including but not limited to charities). Because Zakatify LLC has no control over such resources, you acknowledge and agree that Zakatify LLC is not responsible for the availability of such external resources, and does not endorse and is not responsible or liable for any Content, advertising, products, or other materials on or available from such resources. You further acknowledge and agree that Zakatify LLC shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods or services available on or through any such resource.

Indemnity

You agree to indemnify and hold Zakatify LLC, and its subsidiaries, affiliates, officers, directors, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your Content, your use of Zakatify Services, your connection to Zakatify Services, your violation of the TOS, or your violation of any rights of another, whether you are a registered user or not. The user is solely responsible for his or her actions when using Zakatify Services, including, but not limited to, costs incurred for Internet access.

Resale of service

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of Zakatify Services, use of Zakatify Services, or access to Zakatify Services without the express written permission by Zakatify LLC.

General practices regarding use and storage

You acknowledge that Zakatify LLC may establish general practices and limits concerning use of Zakatify Services and may modify such practices and limits from time to time without notice to you.

Modifications to Zakatify Services

Zakatify LLC reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, Zakatify Services (or any part thereof) with or without notice at any time. You agree that Zakatify LLC shall not be liable to you or to any third party for any modification, suspension or discontinuance of Zakatify Services.

Zakatify LLC's proprietary rights

You acknowledge and agree that Zakatify Services and any necessary software used in connection with the Service ("Software") contains proprietary and confidential information that is protected by applicable intellectual property and other laws. You further acknowledge and agree that Content contained in sponsor advertisements or information presented to you through Zakatify Services or advertisers is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. Except as expressly authorized by Zakatify LLC or advertisers, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on Zakatify Services or the Software, in whole or in part.

Zakatify LLC does not want to receive confidential or proprietary information from you through Zakatify Services or by email. Unless otherwise agreed in writing by an authorized Zakatify LLC representative, any material, information or idea you transmit to Zakatify LLC by any means may be disseminated or used by Zakatify LLC or its affiliates without compensation or liability to you for any purpose whatsoever, including, but not limited to, developing, manufacturing and marketing products.

DISCLAIMER OF WARRANTIES

YOU EXPRESSLY UNDERSTAND AND AGREE THAT:

YOUR USE OF ZAKATIFY SERVICES IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. ZAKATIFY LLC EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
ZAKATIFY LLC WILL MAKE REASONABLE EFFORTS TO MAINTAIN ZAKATIFY SERVICES; HOWEVER, ZAKATIFY LLC IS NOT RESPONSIBLE FOR ANY DAMAGE, LOSS OF DATA, CUSTOMER INFORMATION OR VENDOR DATA, REVENUE, OR OTHER HARM TO BUSINESS ARISING OUT OF DELAYS, MISDELIVERY OR NON-DELIVERY OF INFORMATION, RESTRICTION OR LOSS OF ACCESS, BUGS OR OTHER ERRORS, UNAUTHORIZED USE DUE TO YOUR SHARING OF ACCESS TO ZAKATIFY SERVICES, OR OTHER INTERACTION WITH ZAKATIFY SERVICES. YOU ARE RESPONSIBLE FOR MAINTAINING AND BACKING-UP YOUR DATA AND INFORMATION THAT MAY RESIDE ON ZAKATIFY SERVICES. ZAKATIFY LLC DOES NOT WARRANT THAT (i) ZAKATIFY SERVICES WILL MEET YOUR SPECIFIC REQUIREMENTS, (ii) ZAKATIFY SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF ZAKATIFY SERVICES WILL BE ACCURATE OR RELIABLE, (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH ZAKATIFY SERVICES WILL MEET YOUR EXPECTATIONS, AND (V) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.
ANY MATERIAL OR INFORMATION DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF ZAKATIFY SERVICES IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.
NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED THROUGH OR FROM ZAKATIFY SERVICES SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TOS.

LIMITATION OF LIABILITY

YOU EXPRESSLY UNDERSTAND AND AGREE THAT ZAKATIFY LLC SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF ZAKATIFY LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE ZAKATIFY SERVICES; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM ZAKATIFY SERVICES; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (v) ANY OTHER MATTER RELATING TO ZAKATIFY SERVICES.

EXCLUSIONS AND LIMITATIONS

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS OF THIS SECTION MAY NOT APPLY TO YOU.

US Government's restricted rights

The materials on the Service are provided with "RESTRICTED RIGHTS." Use, duplication, or disclosure by the U.S. Government is subject to restrictions as set forth in applicable laws and regulations. Use of the materials by the U.S. Government constitutes acknowledgment of Zakatify LLC's proprietary rights in them.

General

Notices to you may be made via either email or regular mail. The Service may also provide notices of changes to the TOS or other matters by displaying notices or links to notices to you generally on the Service. The TOS and the relationship between you and Zakatify LLC shall be governed by the laws of the Commonwealth of Virginia without regard to its conflict of law provisions. You and Zakatify LLC agree to submit to the personal and exclusive jurisdiction of the courts located within Fairfax County, Virginia. The failure of Zakatify LLC to exercise or enforce any right or provision of the TOS shall not constitute a waiver of such right or provision. The TOS constitutes the entire agreement between you and Zakatify LLC and govern your use of Zakatify Services, superseding any prior agreements between you and Zakatify LLC (including, but not limited to, any prior versions of the TOS). You also may be subject to additional terms and conditions that may apply when you use affiliate or other Zakatify Services, third-party content or third-party software. If any provision of the TOS or incorporated documents are found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the TOS remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of Zakatify Services or the TOS must be filed within one (1) year after such claim or cause of action arose or be forever barred. The section titles in the TOS are for convenience only and have no legal or contractual effect.
